Eligibility

To use our Services, you must:

Be at least 18 years of age (or the age of majority in your jurisdiction).
Possess the legal authority to enter into a binding agreement.
Agree to provide accurate, current, and complete information as requested.

Registration and Account Security

You may be required to create an account to access certain Services.
You agree to keep your login credentials confidential and to notify us immediately of any suspected unauthorized use of your account.
We reserve the right to suspend or terminate accounts that are inactive for extended periods or that violate these Terms.

Fees, Payment, and Refunds

All fees for Services will be provided in writing (via proposal, invoice, or Service Agreement) prior to commencement.
Payments are due as outlined in the Service Agreement (e.g., 50% upfront and 50% upon delivery).
We accept payments via major credit cards, PayPal, and bank transfer.
Late payments may incur a late fee of 1.5% per month on any outstanding balance.
Refund policies vary by service:
- Ghostwriting & Editing: No refunds once work is delivered.
- Design & Formatting: One round of revisions is included; subsequent revisions may incur additional charges.
- Audiobook & Printing: Custom services are non-refundable once production has begun.
- Marketing & Promotion: Fees are non-refundable, but performance metrics will be shared as deliverables.
If you dispute a charge, you must notify us in writing within 7 days of the invoice date.

Client Obligations

Provide all necessary materials (manuscript drafts, instructions, assets) in a timely manner.
Respond to revision requests or queries within 5 business days; delays may affect delivery timelines.
Ensure that all materials furnished to Dany Book Publishers LLC do not infringe upon any third-party rights (copyrights, trademarks, privacy, etc.).

Intellectual Property

Client-Owned Content: You retain ownership of your manuscript, characters, storylines, and any proprietary content you provide.
Work Product: Upon full payment, you receive exclusive, worldwide, royalty-free rights to the final deliverables (text, designs, audio files, etc.) created for your project.
Company Portfolio Rights: Dany Book Publishers LLC retains the right to display excerpts of work (text samples up to 500 words, cover thumbnails, etc.) in our marketing materials and portfolio, unless you expressly request confidentiality in writing.

Revisions and Approval

Each service includes a predefined number of revision rounds as specified in the Service Agreement.
Once you approve final deliverables in writing, no further revisions are included without additional fees.

Confidentiality

We value your privacy and treat all manuscripts, ideas, and sensitive information as confidential.
We will not disclose your unpublished work or personal details to third parties without your consent, except where required by law.

Warranties and Disclaimers

We warrant that Services will be performed in a professional and workmanlike manner in accordance with industry standards.
Except as expressly provided herein, all Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied.
We do not guarantee specific sales figures, bestseller status, or distribution outcomes. Any projections or estimates are for illustrative purposes only.

Limitation of Liability

To the fullest extent permitted by law, Dany Book Publishers LLC and its affiliates shall not be liable for any indirect, incidental, consequential, or special damages, including loss of profits or data, arising from or related to these Terms or the use of our Services.
Our total aggregate liability for any claim arising under these Terms shall not exceed the amount you paid to us for the specific Service giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Dany Book Publishers LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to:
